Texas REALTORS® is considering revisions to its residential sales, leasing, and farm and ranch listing agreements based on upcoming changes to the law and new MLS listing options. The proposed changes include the following:

  • Paragraph 5A(2) related to broker’s fees removes option to pay a subagent (Note: Subagency will no longer be recognized in Texas as of Jan 1, 2026, and this change is preemptive to correspond with the law.)
  • Section 6 related to listing options adds the new delayed market listing exemptions along with required client notifications to comply with MLS rules requirements
  • Section 19 related to addenda and other documents adds the T-47.1 Declaration as an addenda option.

Note that a draft of only the Residential Real Estate Listing Agreement Exclusive Right to Sell (TXR 1101) has been posted, but identical changes will be made to the leasing (TXR 1102) and farm and ranch (TXR 1202) listing agreements.
